The Penang government’s mediator role between the Kampung Buah Pala residents as well as the landowner and developer is as good as over. Chief Minister Lim Guan Eng said that as far as the state was concerned, the matter ended when some of the villagers sought help from Barisan Nasional.

Seri Delima assemblyman R.S.N. Rayer will not be taking legal action against Kampung Buah Pala Residents Association assistant secretary C. Tharmaraj over an allegation the latter made during the recent stand-off with the developer.

Rayer, who is also a lawyer, however, said that Tharmaraj must retract his statement and apologise for claiming that gangsters from Air Putih constituency were sent to the village during the recent stand-off with the developer.

GEORGE TOWN: Kampung Buah Pala Residents Association assistant secretary C. Tharmaraj has 48 hours to retract his remarks claiming that gangsters from the Air Putih constituency were sent to the village during the recent stand-off with the developer. He also needed to apologise for making the statement or face legal action, said Seri Delima assemblyman R.S.N. Rayer.

“First he told Chief Minister Lim Guan Eng to go back to Malacca, and now he is saying that “people” were sent from Air Putih constituency,” he said when asked to comment on Tharmaraj’s claim that gangsters were brought into the village last Thursday when the developer wanted to demolish houses there.

GEROGETOWN (Aug 11, 2009): Chief Minister Lim Guan Eng (DAP-Ayer Putih) was questioned in the state assembly today about his own role in the Kampung Buah Pala controversy when it was pointed out that his administration had collected the final instalment payment for the land’s purchase even though the validity of the premium had lapsed.
In reply, Lim said it was the state executive council under the Barisan Nasional (BN) that had approved the alienation of the land twice (on Aug 18 2004 and June 8 2005).
"The development approval had also been given by the Penang Island Municipal Council (MPPP)," he said.
"Once the premium was settled, the title had to be issued. This was an administrative procedure," he added, noting that the BN government had approved the deal and collected the initial payment.

Meanwhile RSN Rayer (DAP-Seri Delima) pointed out that the MPPP had approved the demolition of the houses on the land on Dec 8 2006, long before the title had even been issued to the cooperative.

GEORGE TOWN: Four of the 24 Kampung Buah Pala houseowners have agreed to the compensation offered by developer Nusmetro Ventures (P) Sdn Bhd.
Seri Delima assemblyman R.S.N. Rayer said the four signed the agreement last Friday before the offer expired on noon that day.
“Initially, 15 houseowners agreed to the offer but only four turned up to sign the deal at Deputy Chief Minister II Prof Dr P. Ramasamy’s office.
Rayer also explained that his promise of protecting the village “over my dead body” was made on condition that the villagers had to vacate their homes without getting a single sen.
“The circumstances is different now.
“They’re offered double-storey houses worth about RM500,000. I don’t see any reason for me to stand in front of the bulldozers,” he said.

THE Island Glades and Island Park neighbourhoods in Penang have been known to be picture-perfect areas but the rising number of crime cases over the last year has the residents living in fear.
Seri Delima assemblyman R.S.N. Rayer, whose constituency covers Island Glades and Island Park, said after discussions, residents wanted to talk with the police first to give them a chance to help solve the situation.
“Of late, the police have actually stepped up their presence in the area with multiple road blocks and this has greatly helped the situation,” Rayer said.

The state government will file an application at the High Court Tuesday to invoke Section 116 (1)(d) of the National Land Code to prevent the demolition of houses in Kampung Buah Pala.

said they had initially wanted to file in the application Monday but North-east district officer Azizi Zakaria had yet to sign the documents.
